Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of GrubScout (the “Service”) operated by GrubScout (“we”, “us”, “our”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

GrubScout is a directory and discovery platform for food trucks and breweries in San Diego County. We display information provided by operators and from public sources. We do not prepare, serve, or guarantee the food, beverages, or events listed on the platform. Hours, locations, menus, and availability change frequently and may be inaccurate.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service you represent that you meet these requirements.

4. Accounts

You may sign in via email/password, Google, Apple, or phone OTP. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a security risk.

5. Operator Subscriptions and Payments

Food truck and brewery operators may purchase subscription plans and add-on credits (e.g. SMS packs). Payments are processed by Stripe. By purchasing a subscription you authorize recurring monthly charges to your payment method until you cancel.

Cancellation. You may cancel a subscription at any time from your operator dashboard or the Stripe billing portal. Cancellation takes effect at the end of your current billing period; you retain access until then.

Refunds. Subscription fees are non-refundable except where required by law. SMS credits and other one-time purchases are non-refundable once issued.

Booking commissions. If a booking commission is configured, operators agree to pay the commission amount on accepted bookings as displayed at the time of acceptance.

Price changes.We may change subscription prices with at least 30 days’ notice. Continued use after the change takes effect constitutes acceptance of the new price.

6. Operator Content

Operators are responsible for the accuracy of all content they post including business name, address, menu, hours, prices, and photos. By submitting content, you grant GrubScout a non-exclusive, royalty-free license to display, distribute, and promote that content within the Service and in marketing of the Service.

You represent that you own or have rights to all content you submit and that it does not infringe any third-party rights.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate another person or business
  • Submit false, misleading, or fraudulent business information
  • Scrape, harvest, or mass-extract data from the Service
  • Attempt to disrupt, reverse-engineer, or compromise the Service
  • Use the Service to send spam, harass other users, or distribute malware
  • Resell, sublicense, or commercially exploit access to the Service without our written permission

8. Third-Party Services

The Service uses Stripe for payments, Twilio for SMS, Firebase for push notifications, SendGrid for email, Mapbox for maps, and Google/Apple for federated sign-in. Your use of these features is also subject to the respective providers’ terms.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or that information displayed is accurate or current. Food trucks and breweries change hours and locations without notice; verify before traveling.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRUBSCOUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the amounts you paid to GrubScout in the 12 months preceding the claim, or (b) US $100.

11. Indemnification

You agree to indemnify and hold harmless GrubScout, its officers, employees, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms.

12. Termination

You may stop using the Service at any time by deleting your account. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion. Provisions intended to survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service shall be resolved in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the app or email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
